Even if all the external elements of a crime can be proven beyond a reasonable doubt there is always a possibility that subsequent events will show the accused did not meet the mens rea required to be morally culpable. This is obviously an unlikely scenario but the possibility of this occurring is not zero, therefore, irreversible punishments such as death cannot be tolerated in a civilized society. Not arguing that I particularly like this system but this way of thinking is required if we allow the ideas foundational to the common law, namely that any accused is presumed innocent and that guilt must be proven by the state BARD for all elements of the actus reus and the mens rea.
