Some madman created a site that is scraping all of the job boards companies use to hire H1Bs and posting them in one consolidated place. Supposedly, a company cannot pass over an American citizen for a job in favor of a H1B without jumping through a ton of legal hoops. This is why companies post the jobs places Americans do t know about but foreigners do. The visa and H1B subreddits are not happy about this.

That's a myth. There's nothing in the law enabling H1B visas that require them to hire an American with the required skills. The only requirement is that the job "pays the prevailing wage". Since imported labor drives down wages, the prevailing wage goes down. And there's little to no enforcement anyway.

No. A PERM is an application a corporation files to sponsor a foreign worker.

The certification process mandates that the firm validate the need to sponsor said foreigner by showing domestic talent is unavailable.

There is no magical way to convert an LCA to a PERM because an LCA is temporary in nature (both start and end dates).

Treating them as the same and glossing over the DISCRIMINATION HARMING CITIZENS is part of the game played by advocates for foreign labor.

While a firm has no obligation to HIRE a candidate… they do have an obligation to EVALUATE each candidate (which most simply do not follow through with)

If they run a campaign and Americans apply, then certify that Americans couldn’t be found without interviewing these candidates — THEY HAVE BROKEN THE LAW.

And each candidate can file a charge with the DOJ IER for citizenship discrimination, receive a right to sue and sue the

PERM is a Green Card application. It's when a jeet tries to go from H1B to being a permanent resident. That's the one that actually requires hiring an American first if they exist (which they always do but companies like to pretend not to see them). But for the H1B itself, they can openly tell Americans to go fuck themselves.

This is why their site allows you to log your application for when you file a lawsuit or complaint you have supporting documentation that you applied.

That is somewhat true for H1Bs with the exception of companies the Department of Labor has had enforcement actions against for discriminating against Americans in favor of H1Bs. That’s when all sorts of rules, hoops, oversight, and additional penalties kick in. Lots of major companies are in this boat. And if there was no such thing, why are their shadow job boards?

Funny story we had a soccer coach on a student visa that wanted us to sponsor his citizenship. In order to do so we needed to hire him at 30k minimum and have no American job seekers. I think we had to pay some money too. Anyway… we told him to kick rocks that we have plenty of Americans that want that job. He started pitching a fit about how we should just post the job in secret.
