Nope. One of the downstream distributors sent it by accident before the release date. An honest mistake since the set he ordered is called "March of the Machines" and the embargoed, unreleased set is called "March of the Machines: Aftermath."

If anybody broke the law, it was WotC. The distributor and YouTuber would only be criminally liable if they stole the cards or defrauded someone to obtain them. The distributor may be civilly liable for breach of contract by shipping them early, though. WotC and Pinkerton, on the other hand, seems to have intimidated the man on loose legal footing. That's criminal.
