"You can indict a ham sandwich" is a very known say regarding grand juries, prosecutor have the opportunity, unchallenged, to present their evidence, on their term, under their narrative to a grand jury and only need simple majority to ensure an indictment. Ergo "You can indict a ham sandwich".

So its extremely TELLING of how incompetent a prosecutor or how bullshit a case is when they fail to secure one.

Jury Nullification is for TRIAL when the Jury acknowledges the incident but refuses to give a "Guilty" verdict. and.

For a Grand Jury you dont need a "Guilty", you just need "We believe there is enough evidence for case". The bar is sooo low that failing to meet it is nothing short of "Shame on you, shame on your family, shame on your cow" cause you dont even need the whole panel to agree, just majority.

There is "Simple Assault" and "Aggravated Assault"

Simple Assault is a misdemeanor, there was physical contact but nothing serious.

Aggravated Assault is a Felony Physical contact, likely with a deadly weapons, intention to cause sever bodily injury.

They could have charged him Simple Assault, get him 10 days in jail and a fine

Instead prosecution tried to "Make an example" out of him, Charged with AGGRAVATED ASSAULT.

They could not convince a grand Jury that throwing a sandwich was a "Deadly Weapon" or that it was meant to "Cause severe bodily injury"

this is why the case blew on them, not cause the gran jury was being defiant, Prosecution was just THAT incompetent.
