It could go either way. But first the rule would need to be implemented by the administrative state with a notice and comment period before it winds its way though the administrative law process. It will be a ban on sale by the ATF and the DOJ will figure out some scheme to enforce it. The death of Chevron makes appealing this much easier but it will take years before it goes up to the Court. Thanks to the recent ruling on injunctions it will be the law de facto for that time. You could make the argument it is an ex post facto law which could speed things up but that is doubtful.

Why wouldn't the Supreme Court allow limiting the possession of firearms to sane people? Makes no sense. It's not the responsibility of the SC to assess if gender dysphoria is a mental illness, just if mentally ill people can be excluded from the right to bear arms. The SC is not a psychiatric expert.

No matter the outcome the ruling will give clarity. If they say no ban is allowed, that can be used to uphold everyone else gun rights across the country, especially in blue states. If they do allow the ban under the case of mental health issues, that pretty much disarms the left.

It's really not, and that's the fucked up part. Think about it this way: ATF forms already ask you if you're mentally ill and it is grounds for denial of the sale. Literally all this legislation could possibly do is add a box on the form "do you identify as a gender other than your birth sex?"

If a tranny says "no" they can still buy the gun. All they have to do is deny a self-identification, which automatically makes them not trans. Only the self-identification makes them trans. Do you see the joke here?
