The courts ruled that as long as most of the income for the company doesn't come from recruitment then its not an illegal pyramid scheme. it still might be a pyramid scheme but they use MLM to distance themselves from the negative connotatiom of "pyramid"

they are pyramid schemes because the structure of the business depends on the pyramid growing but each successive iteration requires a bigger base for the pyramid structure to remain in tact. eventually you can't get any bigger because growth has a limit and because its a pyramid, its not sustainable without a base.
