I respond by pointing out that there's a difference between the law of free speech and the idea, the value of free speech. The law is derived from the idea. Why do so many countries protect freedome of expression in their constitution? Because the value, the idea of free speech is important, and the law reflect this idea.
To cling to the legal definition of free speech while simulatenously acting in a way that disrespects the idea of free speech is to fundamentally misunderstand and betray both the idea of free speech and why it is enshrined into law in the first place.

I can be charitable and say that the licensee doesn't know this to be false and that they have a case in any such action, but they already folded and Kimmel got told to stfu by his bosses. Kash Patel isn't sharing evidence though, he's claiming things without actually giving us the evidence. When Kimmel made that statement, we didn't have the note transcript and we didn't have the messages. There's still plenty of evidence they haven't released.
Public interest also means defending the suspect's right to a fair trial and that means presenting unbiased and fair coverage. Evidence must be evaluated and coherently delivered to make a case.
