Yeah this is an impossible case from a 'beyond a reasonable doubt' perspective.
How the fuck are they going to successfully argue to a jury that a fire, that the guy reported and firefighters say they put out, is the same exact fire five days later?
It's believable that someone else could've thrown a lit cigarette butt in there within those five days. Or many other reasonable possibilities.
This case is a stretch by the DoJ, but it's not news compared to similarly thin prosecutions in other districts.
