Why would he be forced to refund the tariffs? A court order declaring his tariffs unconstitutional would just allow government institutions to stop collecting them without getting in trouble. The tariffs themselves aren't magically void, because the issue isn't with the structure of any of the tariffs, only with Trump implementing them without congressional approval.

Trump will just give some other doubtful legal justification from some other ancient vague law and it'll take another year to fight that out in the courts. Rinse and repeat. Trump has broken the US Constitution the only way back to rule of law is to scrap the presidency since any other president will follow this new pattern of operating arbitrarily in the months before the courts can rule against and then just keep doing the same on some other flimsy legal basis.
