Havok was one of Cap's Unity Division buddies and when O*N*E had him strung up from the ceiling in a gulag just outside NYC Cap was literally volunteering the Avengers to provide security at anti-mutant rallies in Manhattan. In the X-comics he's not allowed to actually give a shit, he only pays lip service to their plight.
