Pocketpair is likely going to win the lawsuit. Japan doesn't have summary judgment so they have to fight or settle. The fact that they're fighting it and still developing the game indicates they do have very strong case.
There's also MS, Sony and Re-Logic continuing to work with them. The law teams would have advised to steer clear if there was a chance of Pocketpair losing.
