from what i've read you have to do something extremely good for nintendo for them to lend you something, it's why pac-man got added in one random mario kart for arcades, because bandai namco helped with the 3ds version of smash (and maybe the wii u one i can't remember) but i also think they were the ones who also developed that one arcade mario kart
