People tend to forget that "Indie" is shorthand for "Independent". It doesn't matter so much who the publisher is, rather does the creative actually owns what he produces.
Spawn for instance is independent as the Toddfather owns that. Same with Robert Kirkman and the Walking Dead. Even some of the old Vertigo stuff like 2020 Visions had all of the rights revert back to Jamie Delano once it went out of print.
What isn't "independent"? Corporate owned IP such as Spider-man, Batman, Transformers, etc.
