>Thank you your honor, I see the defendant doesn't have an understanding of the concept of consumer rights as he clearly believes that the consumer has no right to be able to diagnose or otherwise perform simple maintenance on a product that was purchased with the sole intent of ownership. Your honor, I wish to pursue this matter, in advocacy of my client, the country of Brazil, that Nintendo Co., LTD of Japan is in clear violation of Consumer Protection Code (Código de Defesa do Consumidor - CDC), enacted under Federal Law No. 8,078/1990. In particular, your Honor, Articles 6, I and 8, Right to Safety and Quality, mandates that products such as the Nintendo Switch 2 that are placed on the market must not present undue risks, and a device losing its core functionality could be deemed unsafe or unfit for its intended purpose. If the core functionality is intentionally disabled, such as the ability to restore a console or device to it's default state for the sake of repair and/or maintenance, this could be seen as introducing a defect that compromises the product’s safety and utility, violating the consumer’s expectation of a functional product.
