Sos Sosowski frequently participated in Ludum Dare, maybe he's concerned about legal liability for jam games among others. I've made multiple online-only jam games, and though I do keep up the servers for two of them (more than 10 years after release) for three others I stopped hosting them (not like anybody would be interested anyways). For another two I used to have online high scores, but server migrations broke them and I never got around to fixing them. Perpetual maintenance would be a real pain that would discourage designs like that, similar to how online communications legislation is currently keeping developers from implementing reasonable chat/messaging options in their games.

In my case I always released the source code (server and client) so if SKG gets implemented in a reasonable way I'd be in the clear, but then again do you expect the EU to legislate this in a reasonable way? This is the same organization that gave us cookie laws which just resulted in malicious compliance, as well as the GDPR which big corporations are just ignoring (meaning the whole thing is pointless) while wasting significant resources for smaller companies (I've personally had to sift through e-mail to keep important internal communication from years ago while deleting customer requests).
