Honest answer: DKC was never theirs from a cultural standpoint. It was Rare's. Rare made DKC into what it is. DKC's DNA is all Rare and their British cultural nods, right down to the music, the words, the terminology and the references. Nintendo, a Japanese company can use the characters and settings, but they can't replicate the British flair that DKC had. No company can, even Rare today can't do it. Retro tried but with too much intervention and hands-on supervision from Nintendo. Tropical Freeze feels like an expansion rather than a sequel. DKC2 was a full-fledged sequel.
