Its an oversight but sub light flight forgot to put only works in the vacuum of space, there are two other flight spells in "fleets of the galaxies" one slower one ftl, both require you to be in space to cast.
They forgot to say that in sub light
If I was your gm id say its an oversight and require you to be in space....
But raw it doesnt require it
