Does the vatican change any of Michaelangelos art after the fact with someone else and claim it as Michaelangelo's?
No. But videogame companies do.
Can they commission and request? Sure, but can they compell and micromanage exactly what Michaelangelo expresses via his brush?
No. It is seen as the clients fault for not understanding what the style would be.

There is an argument these COULD be art... but again the art comes from the player playing which would make the player the artist. No player, no art.
Meanwhile a concert, play or show can play to a completely empty venue and still be unchanged and exactly as the creator intended even with no one to witness it.
