It’s not waived. It’s conditionally released so that you can continue to serve as a commissioned officer. Army guard to Army officer happens all the time. It’s not a big deal, and your command might even be required to release you by Big Army (not sure though).

You would need a signed conditional release from your commander, and, hypothetically, they can deny it I think. However, unless your commander hates you, he’ll probably sign it. It’s not a big deal and happens a lot. Just don’t be a shitbag on your guard duties.

Army to Air Force as an officer? Short answer: No.

Long answer: Yes, the Air Force takes officer service transfers, but only for job slots they’re really struggling to fill. Which, right now, the Air Force is not struggling to fill any officer job slots, so the answer is basically no unless something really changes in the future and you get crazy lucky.
