Well, I think the issue is that if you did cheat (detected by whatever kernel level solution being used etc) you'd end up being banned on the hardware level as an alternative to simply the account level, but we don't want them to normalize this because it won't be used only for cheaters as soon as bean counters figure they can use it to punish anyone they don't like

That isn't true really - you can buy a new TPM chip for your motherboard for far less than a motherboard, in most cases. Pic related. But it does take buying one that works for your mobo manufacturer and type. Most higher end motherboards even on mainstream platforms have a place to plug in a new TPM module, but there are some cheaper ones, laptops etc.. that don't.

You could, but HWID can be faked. Also, is it exposed to any third parties? MS allowing others to use it as an identifier for generic usage seems undesirable for many reasons.
