No, it's owned by ZUN and he can pursue legal action toward people who use the franchise for fanworks if he wishes. But he's purposefully hands-off and has a guideline for fanworks you can follow to make and sell your own fanworks. It's basically as close to public domain you can get since he basically gives you the carte blanche. He was engaged in a lawsuit with some guy who tried to copyright Yukkuri (a certain type of Touhou fanwork) and BTFO'd them, then he went back to allowing anybody to make "Yukkuri Explains" stuff which is basically like Vtubers that are very popular with kids in Japan.
