Most flight sims have lived in a grey area of the law since the genre started. The Activision lawsuit with GM about using Humvees ended up in their favor, which is to say that depicting military equipment as a part of authenticity is probably okay. However it's not well-trodden legal ground. EA and Bell settled out of court (BF4 calls its helicopters Venoms and Vipers, which is a Bell name), probably because they didn't want to help set legal precedent. Some games will actually seek out real licenses for their jets. Ace Combat for example licenses everything. That is however, the exception.

You can PROBABLY depict accurate military equipment. You are SAFER if you never call them by copyrighted or trademarked names, and instead only by their public domain military designations. E.g. don't call your missile a SIDEWINER®, just call it AIM-9. You are SAFEST if you just make up something legally distinct, which is the route Activision has gone in COD because even though they won their case against GM, it still cost them a ton of money and they'd rather not have to deal with it again.

Something else funny, is that I think some companies are wizening up to the military designation thing. Raytheon now trademarks not just the Sidewinder name, but also AIM-9X.
