The keep ruling against it because the schools keep pretending that these are primarily students who just happen to be amateur athletes who like to play for their school. If they were employees, all manner of restrictions would be legal. But the schools don't want them to be employees, they want to continue the fantasy that they're amateurs, some of whom now make millions per year. Because of that fantasy, there are far fewer restrictions that the schools can place on the athletes than if they were employees.
