Orochimaru was never dead. He hid inside Sasuke and came out to fight Itachi. Then its revealed those curse marks can revive him because Sasuke can't perform Impure Resurrection cause he wasted time with Kirin the jobber move. I am convinced Orochimaru got sidelined caught would trivialize the fight against Madara and Kaguya.
