This is something most people implicitly agree with as well. They think killing, torturing the innocent is wrong and should be punished with death/torture but what actually qualifies as innocents? It's not something they give much thought, otherwise they'd quickly realize free will is an illusion and we were all forced at all times. Your conscious thoughts are controlled by unconscious phenomenon. You don't decide for any neuron to fire, any synaptic pathway to form, any cell to reproduce. If all of that is unconscious then where exactly is the difference between consciousness and unconscious? Where is your soul? The distinction is arbitrary. You are a complex rock.

And then they go on to have kids which inflicts much harm onto the child and others. Life is a death sentence of course. Most humans are tortured as well to add to the crimes of the parent.
