I guess the real question is if Retro and Next Level were actually forced by Nintendo Japan to exclude the Kremlings and it's just that the latter are now beginning to change their minds.

The word on the grapevine circa 2018 is that K. Rool's hiatus was the result of "internal apathy and factional disagreements" on NCL's part and apparently him doing so well on the Smash ballot is what ultimately convinced them to change their mind on the character going forward. One thing that kinda sorta backs that up is this interview with Tanabe circa 2010 in regards to DKC Returns, where he seems to heavily imply that he and Miyamoto came to the mutal agreement that K. Rool didn't need to return and thus instructed Retro to create their own antagonists instead, even going so far to say "make sure there's no crocodiles". https://www.youtube.com/watch?v=uAw2UnqHJt0
On the flip side of things, you do have Reece of Kiwi Talkz, who recently was completely correct about the Kremlings making a comeback, also claiming that all reports of Nintendo disliking the Kremlings and not allowing Retro to use them in their games was bogus, so that take that as you will. Dude has a lot of contact with Retro Studios staff so I could see it, so perhaps the Kremling thing in Returns was really just more of a mutual agreement on Tanabe/Miyamoto and Retro's part.
