Lot of words to try and wiggle around that AK = die on people
Also more seriously no, stepping back and being a lot more serious about this, Ken's spiritual are momentary effects. he doesn't live his life in a perpetual state of enlightened chi magic. Just talking about him vs the what if of a killing curse touching and not making it about a wider vs i do say it really aught to still get through it.
We're shown that the power behind the unforgivable curses are variable based on the caster's intent/conviction. They're not automatically divinely blessed with max power just because they are what they are. The kids try to use Crucio and are too soft (not an insult) to really make it land like it should. Whether it's weak or with all the convictions of a wizard hitler, you're still going to die.
It's one of the big famous spells in the setting; if people say it has never failed prior to Harry, it's reasonable to at least assume that it's been tested against, and succeeded against, most of the other things in the setting one could expect to encounter.
Like, in the entire history of expanded hp-verse it's a tall ask to suggest it's never been cast on a werewolf, or a giant, or a dragon, or just a wizard with Melbordorf's Endless Regenerating Charm.

It's not that.
When Fawkes is hit with AK his body dies but he is reborn, cos Phoenix, in my mind this means that AK doesn’t actually damage or remove the soul in the same way that a Dementor’s kiss does. It genuinely does seem to be an 'the effect is death' spell.
