with pokemon it's a bit more complicated then that what with creatures, TPC, gamefreak hence why they are able to develop outside of pokemon, Nintendo only really has the IP (partly) they basically let game freak do whatever and don't own them wholesale.
Hal technically could break off and be their own thing but since Nintendo owns the Kirby IP it'd be a really stupid idea to do that from a business perspective the chances of that ever happening are slim to none and they are smaller studio compared to the heavy hitters.
