because he obviously killed many innocent reachmen who didn't manage to flee from him and his drunkards. raerek makes it clear that he doesn't support ulfric because he's seen what ulfric's capable of given the opportunity - further showing ulfric's genocidal nature at markarth.

ulfric just didn't count on getting arrested - that's why he became dormant and uncooperative.

talos ban was not enforced, yet ulfric demands it as payment? why? because it forces the empire to openly break the terms of the concordat, thus paving the way for the dominion. that's why he was elenven's special asset.

this explains why the priestess and her husband still visit the temple of talos under brunwulf's reign. elenven and her justicars will have to pack their bags.
