You won't get executed for it. But there is a difference between say, using 6th edition Space Marines in your 2nd Edition game, and back-porting Primaris or whatever other new units.
The Oldhammer movement is very... woolly. You could play a Rogue Trader "Battle at the Farm" scenario with modern miniatures. You could play Renegade Scout, a modern ruleset, with a mix of old lead miniatures and modern "retro" 3D printed miniatures.
It's about what you and others get out of it. It's about your hobby and your social contract to your Oldhammer community.

Early 40k has no real concept of "correct base sizes" or even bases being necessary, past some hazy tournament rulings about using the bases originally supplied with the miniature. You just see people's Dreadnoughts rawdogging the table. Yuck.
