This is completely incorrect. Prior to 2008 any and all physical media was completely owned by the person who purchased it.
Even with licensing laws put into place to argue against physical owners, if you own a physical copy of a game and you have the receipt from your purchase - you own that video game. You can even make digital copies of any physical game you own, to this day, so long as the physical file is for personal home use and you have proof of purchase.
