Probably, though I think it's pokemon HQ rather than nintendo that's pushing it so hard. They want all the merch and anime and other shit to fire off at once right after the games, and I don't think that's the right way to handle a multimedia franchise. They need to slow down, and start with the anime to give the devs more time.

1 is just legal compliance. It sucks, but I don't expect pokemon to start legal battles over stuff that doesn't belong in their setting anyways.
2 depends on enforcement. References are shit more often than not, but I could see how this could become draconian, especially if they scrutinize innocuous things as references.
3 4 and 5 are all awful. That's the poison killing games. Writers should be free to depict characters how they want to.
