thanks brewbros, I'm gonna check out the state of my ofw sysnand when I get home to see how to go from there. I mainly want my pre-hack saves on the new console without resetting it. I did clear my prodinfo on emunand too but I think I should have it backed up somewhere, although not sure if the sys prodinfo was cleared as well.
I assume I will have to update sysnand through ninty, burning my fuses, but that ship has since sailed far away I don't think we'll ever get coldboot. I don't suppose I can update sysnand with daybreak and not get flagged?

My sysnand has no pirated shit and it shouldn't be banned as I never touched it after the hack, everything's on emu. You mean to say I don't have to transfer saves from emu to sys? I wouldn't mind having pirated saves on my switch 2 but isn't that just asking for a ban later on? Or would ninty assume I just had a cart from someone else and that's how I have save data?
