The most logical outcome is that if they refuse to release any private server binaries, source code, etc... They will just outright lose copyright strike capabilities of dead games and the versions they run on, if they want to recover the copyright, they gotta launch a new version of the game...

For example.

EA shuts down Battlefront 1 and 2 servers.
Loses copyright against private servers
EA relaunches Battlefront 1/2 + adds new content.
EA regains copyright against private servers if they copy what they added AFTER the release date, if private servers copied the content EA added, they get a copyright strike, but the old version of the game counts as legacy... Similary how Dark Souls and Dark Souls Remastered are separate products.
