If a company fails to disclose that it may render a device’s core functionality inoperable. Article 31 requires that all offers and advertisements provide PRECISE information about the product’s essential characteristics. No where in clear righting upon purchasing this product was an indication made that my client may forgo their control over core functions, such as a system restore, if they in any way violate a single part of the agreed upon EULA. Your Honor, this lack of transparency for of core functionality is deceptive, especially since my client was not warned at the time of purchase that the product’s primary features could be disabled.
