Because the precedent back then was bullshit. "Muh jesus" doesn't actually hold up as a legal ruling in any modern court of law because we're supposed to separate the religion from the state.
But if you go back and read every. single. one of these obscenity laws from the 1800s, they all invoke "muh jesus", sky daddy, and what your local pastor thinks about what you do inside of your pants. Just look at this one:
