theres been a few responses from people who got banned from mig saying they used the old broken firmware, one of them didnt use the new firmware at all i think its probably most likely that the bans are happening from the old firmware failing to launch the games and error logs being sent to nintendo especially since the new mig fw is only a few days old and bans dont normally happen for like a week
