The server software might be made to run on a very specific hardware (Blizzard literally couldn't run their vanila WoW code, because they didn't have the exact same machine).
The server might use third party software, which has a license and privacy agreement, and won't work without it (like nVidia hair, or some multithreading solution, or DRM).
The game might include licensed music or names or other brands, and the license agreement requiring only the license owner hosts the software.
The game server might include security features, anti-cheat, etc, that are still used in other products, and therefore shouldn't be released to the public to look at.
The owner of the code and the publisher/maintainer of the game might be separate companies, there's literally companies specialized in buying dead MMORPGs to milk, and they don't own the underlying code to release it; so when the game dies, its rights are divided between two companies, who might not have common incentive to release the server.
The dead game might be a competitor to an ongoing product by the company, so they'd lose on potential profits by releasing it for free (Overwatch 1, Overwatch 2, etc).


Any law for this must only be for future releases, which will include these consideration into their design phase. Already released games can't be grandfathered in.
