the USPTO used to use a "first to invent" standard, meaning if prior art could be found, a patent would be invalidated.
but a number of years ago they switched to a "first to file" system. now it doesn't matter if you patent something that was invented by someone else decades ago. if you're the first to file for it, you can shut down anyone for the life of the patent.
