Because it's really just "fake physical games where the storage overheard is passed onto the customer". You could argue disc based games have already been like this for a couple decades already, but the difference is the data is actually on the disc, but the issue here is also compounded by the fact Nintendo wanted to use a more expensive storage medium on top of games being larger in size.

If cost was such an issue, they should have just used Switch 1 carts as a storage medium for Switch 2 games so they're functionally like their disc based counterparts. It won't play off the cart, but it's still used for verification.

It's just shit optics all around and you should be asking why Nintendo aren't using these themself to begin with. Maybe they're throwing opportunistic 3rd parties under the bus so they don't have to test the waters in an attempt to warm customers to the idea while Nintendo itself doesn't catch the heat.
