they did this intentionally, a country can easily be held accountable. while different rules apply to a state. Notice how the ukraine territory never registered it's borders, or it's flag either. Palestine is a country. Under international law, any crimes that take place there can be called Palestinian crimes regardless of who commits them. Palestinians are genociding themselves.

Where this works against Israelis is that an occupier has NO right to defend themselves. Under international law there is no such thing as a civilian occupier. all Israelis are combatants and or belligerents.
Someone who breaks into your home, has no right to defend themself, you as a homeowner have a right to defend yourself, and your family are civilians. If a home invader brings children with them while they are trying to kill you and steal your home, those children have no tight to defend themselves.
