Which state/county/city you're in? If you're in a very liberal area they typically leave these places alone and rarely charge people who go there. It's just really hard for law enforcement to prove you were there for sex because they need solid proof. I believe he wasn't used to the best of his potential, this guy if used properly can be the best chaotic neutral force in comics.
in the hands of a proper writter he would have been the rare example of a force that needs both villains and heroes working together to defeat, and since he made it personal with mary jane then spidey would have a valid reason to kill him.
