Surely under the current legal system this means it's possible to prosecute someone for saying "two tier" as it causes offence

Surely the underlying issue here is that people are calling for the laws to be changed, that they want their legislator to, you know, legislate and reflect the desires of the electorate. The law isn't something divine, unalterable given to us by a third power. The law is whatever we decide is the law and people are asking for changes to be made.
Someone who is "pragmatic" would have gone into corporate law and made loads of money for themselves while having no public repuation.
