How'd they get away with it? This scene aside the entire film is people getting machine gunned down, mobland executions, and other violence.

It's by making it 101% hammy and stylized.
It's action noir with Pacino making funny accent, quoting founding fathers. Meanwhile this your typical mobster that gets gunned down.
The worst it got is Disney opting to offload the distribution to Touchstone.
