If Luthor wanted to execute Superman, he would have done it effortlessly after he got Kryptonite poisoning. He was holding him until further notice from the US government and to torture him for his amusement. He could have killed him in the beginning of the movie too, when Ultraman beats him into the ground again and Superman can barely stand. Lex just calls off Ultraman rather than have him finish the job. He wanted to tear down the idea of Superman before killing him, and only decides to fully commit to killing him once his plans start crumbling.
