Batman is perfectly justified in avoiding killing whenever possible given he has tremendous resources for non-lethal weapons and extensive training in non-lethal combat, but expecting an average person in a life or death situation to choose death simply so they can die feeling morally superior while a violent maniac remains on the loose is completely unjustifiable.
The real flaw in his philosophy is not recognizing that some villains, who re-offend constantly and persistently escape confinement in jail or mental institutions, and whose murders are both overwhelmingly provable in court and often self-admitted, should not be executed following a trial and conviction. If he wants to avoid extra-judicial killing and has the resources skills to render these people to the authorities, good for him, but the plot lines where he intervenes to prevent a death penalty are retarded. I guess that's more common in the comics than the movies.
