Tolkien Estate has only sold the filming rights to The Hobbit and The Lord of the Rings. JRR wished they wouldn't sell any other rights after his passing. Christopher has held to that. When he is gone, the situation might change. But as of now, all the studios can only mine stuff from Hobbit and LOTR, appendixes, citations etc. That's the reason why ROP has to invent stuff, because they can also only use stuff mentioned in the Hobbit and LOTR.
