Picard is captain because he can be trusted to disregard the rules when it serves the greater interests of the Federation and/or protects the wellbeing of the ship and crew. The higher up you are on the ladder, the more leeway you have. Leaders who blindly follow the rules are shit. (You) need the rules because without them you’d be out there murdering, raping and stealing everything that isn’t bolted to the ground. Picard doesn’t need them because he’s already demonstrated through decades of commendable service that he respects the rule of law, but is also capable of acting outside the law when the situation demands it.
