Depends on the state. In some states, you'd be completely allowed to do that. In others you'd have some activist Judge lock you up and throw away the key.
You should look up which states allow castle doctrine and figure out where you lie within those states. I'd also suggest looking up previous and similar cases and how those were handled. It's always a good idea to be familiar with the law and how your states laws are handled. Also never speak to the police ever. And I say this as someone who usually supports police in most things. Never ever speak to them. They are not your friend. You cannot get yourself out of a problem by speaking.
