The reason this disclaimer exists for any media dependent on the distribution of copies is specifically to give those owners to legal right to press charges should someone copy and distribute their work.
So LEGALLY, for primarily their own protection, companies HAVE to inform you that what you are purchasing is merely a license, and then you do not legally own the code or copyrighted material within the product you have purchased. This legal distinction must be made to cover their own asses.

In contrast, there is no law preventing you from redistributing the one copy of the game you DID purchase. We legally do not have the right to sell distribute copies/reprints, but we DO have the right to distribute legal copy of the game we own. If we didn't, then we wouldn't be able to lend them to friends, nor would we be able to sell them as second-hand goods.
The reason companies use DRM is primarily due to the overwhelming number of bad actors who do redistribute copies of their games online. If people kept their home-made copies to themselves and never distributed them to others ever, we wouldn't be having this conversation.
