Damn, now that person is going to have to return that not working Switch 2 to the store as not working and get a new switch 2. What an inconvenience.

>Legal dumps.
Fun fact, nothing since the wii u has been "legal" to dump due to the encryption the nintendo roms now have.
Copying your games for the sake of preservation is legal.
Using emulation software is legal.
These two together make pirated emulation technically legal, but it does not cover the encryption needed to emulate and dump roms for modern nintendo consoles (dunno and don't care if xbone and snoy have them).

No, they don't. If you emulate your own dumps that isn't piracy (copyright infringement).

In some jurisdictions making a backup copy is perfectly legal. Where it's not or only if you don't technically break any copy protection and the like it is indeed piracy (copyright infringement). But if it's legal it's not piracy (copyright infringement). Legal piracy (copyright infringement) is an oxymoron.

Yes. You knowingly purchased a device that is not intended to be moddable, knowingly violated the EULA, and knowingly suffered the consequences.

It's also not a brick. The retard in OP's
>Twitter screencap
is still able to play Switch 2 games offline locally, assuming they have physical cartridges for the games in question. No updates, DLC, and presumably no downloading software assuming it's one of those games that doesn't come with a physical cart.

Granted, we can assume for the sake of argument that Nintendo can remotely disable the console entirely, but that's not what's being reported.

You have the right to not purchase the console if your intent is to hack, modify, or otherwise load software onto it that it was not intended to run.

See how quickly that argument gets dismantled?

If you really want a "homebrew" portable console, you've got the Steamdeck which is very popular, and a whole plethora of Android-based devices you could be using instead.

>just because it wasn't intended to make a boat out of my car i can still make it
Still a completely irrelevant argument. You're not contractually bound to a specific EULA with a car as you are with a Switch. Except for this one small thing...

>tint your windows too dark
>install illegal engine modifications
>get arrested because the car is no longer street legal
>WTF, my rights???

Also:
>if i CAN mod the console to my liking i should be able to
That's a fair philosophical position, and you're totally right. You can, indeed, mod your Switch. And Nintendo can, indeed, zap your Switch as a consequence if you're not careful, which you've agreed that it is allowed to do.

>blatant whataboutism
We're not talking about joycons or other accessories, but the principle is identical. You've agreed to use the console in a very specific way, and if you violate that implicit contractual agreement (EULA), then Nintendo responds accordingly.

It's not "bullshit" mentality. It's called Contract Law.

EULAs are not legally binding
tinting your car windows too dark is not prohibited by the car dealer

as long as you have bought a product you should be allowed to do with it what you want
at least you should be allowed to do way more as nintendo tells you not to do

i believe that shit wouldn't fly in the EU

To be clear, you can dump them and use the digital copy that you created. "Download" in that sense, not that you can download some else's copy even though you have a copy of it physically. If it were to come down to it, you may need to prove you actually dumped the games in question if you were ever brought to court over having a digital copy.

I know a few people that autisticly dump their own games and keep their games. One of them keeps those dumped games in those vacuum food safe bags and put those in their basements to preserve them. Alot of people dunp games, those game dumpers are always sold out almost immediately every time they go on sale and only the kits you have to solder are ever in stock.
I don't know a person in real life that openly pirates old games.

Wrong, on all counts.

EULAs are legally "binding" in the sense that if they are validly written, they are highly defensible in court. We've known about Nintendo's capacity to do this for ages, and the consequences aren't news to anyone.

The point I was making about the car was not that it was prohibited by the car dealer, but by the relevant legal authority- in the case of vehicles, State regulations and statutes.

You then shift to what is known as an "ought" claim, which again, is still defeated by the aforementioned EULA.

I also don't give a fuck about the EU.

Even the moralistic/emotional argument (which is the only real one you can make, because the legal one has been thoroughly and repeatedly debunked) falls flat on its face when I point out the following: Nintendo is not requiring or mandating that you purchase its console. If you don't want to support what you feel are draconian practices, don't buy the damn thing. Or, if you're feeling lucky and want to waste time and money on a lawsuit you will 100 percent lose, take them to court.

Otherwise it's just whining.

to make an analogy, let's say your house is burning and i'm cheering over the fact, does that mean i support tree genocide and global warning? no, i'm just happy you got fucked over
any piratechad with a brain is either leaving the filmware in version 1.0 and praying for a software hack or simply waiting for the modchip in a few years
>were ryujinx and yuzu retarded?
yes
yuzu devs were happily sharing prod keys and leaked roms like TOTK and metroid prime on top of gatekeeping optimizations for those games behind their patreon
they were retarded to the point of almost giving nintendo a reason to outlaw emulators in a silver platter
ryujinx devs were slightly less retarded but their pisscord was still full of people sharing pirated rom links and the emulator itself automatically downloaded the setup needed with one click, prod keys and filmware data included

Almost none of your software is your property, unless it's literally FOSS. You don't own any of the executables, files, libraries, images, and you can't do anything naughty with them, like copying and reselling. What you own is a limited license that states what you can do with the software and what you absolutely cannot.

Does anyone even care about copyright law in the first place? According to those idiots, you're not even allowed to emulate games you bought, that you dumped yourself, and that you still have possession of. You know why? Because the versions on your pc are "archive copies" which can't be touched unless the originals no longer function, BUT if they don't function anymore, then Nintendo argues that you can't keep the backup copies because somehow your right to play the game ends with the original copy's functionality, so what's even the point of making a backup? Some IT guy wanna fill me in how this works?

It'd be like me making a backup of my hard drive incase my computer fails, but I'm legally obligated to smash the backup drive if my computer dies because some idiotic reason.

It's completely screwed, anon. The system is basically designed to keep you from ever truly "owning" your games. They sell you a disc or a cart, but the second you try to do anything outside of their approved ecosystem, suddenly you're a criminal. Emulate your legally dumped copy for preservation? Illegal. Mod it to fix bugs or improve it? Illegal. Even if the servers are fried and they’ve stopped making patches, nope, hands off. It's control, plain and simple. They want you rebuying the same damn game on every gen instead of just letting you use what you already paid for. Welcome to the dystopia where you "license" your memories.

Not to sound like a corporate bootlicker, but nintendo emulatorfags brought it on themselves. A large majority of the emulator devs are nintendofags, so emulators of Nintendo consoles are the best by far, easily beating out Sony, Microsoft, Sega and other consoles easily. The problem is that the emulator fags were too loud about emulating the console the Nintendo was currently selling, even having shit for games that weren't even released yet. Of course Nintendo was going to triple down on their next console.
Other emulatorfags are at least quiet about their shit; the ones that aren't quiet are emulating consoles that are at least a decade old, meaning that the companies aren't gonna give two shits about them.

3rd world countries do not have corporations and instead worship a permanent leader who keeps them submerged in their misery and feeds them scraps only to keep the populating barely alive.
Westoids are full of niggers and faggots commanded by kikes who want to push unions everywhere until everyone lives in their filth.
Japan is meanwhile an organized 1st world nation country.
How are corporations in the wrong?

The DRM is the encryption on the game code. When you dump a legit switch game to the mig switch, you are also dumping the encryption keys which you then use to decrypt the game when you play it. So the encryption is never actually cracked.

It's for protecting your rights, fortunately your rights aren't the only rights that exist and creator rights supersede consumer rights.

why do you zoomers think that you are entitled to piracy?
back in Gen 7, logging in to PSN or Xbox Live with a modded PS3, PSP, OG Xbox or Xbox 360 meant getting permanently banned from using online

nothing has changed, except zoomers now virtue signal on twitter or reddit how "red pilled" they are and how they are "owning the corpos" by openly admitting to doing piracy with their real names attached to their profile

No, that is the one thing you can't copy. The keys are explicitly protected under law and is why Yuzu for instance got killed they were actively sharing the keys. Big shock they got fucked by Nintendo when that's the one thing you ARE NOT allowed to do.
Since you're a bit slow let me break it down for you.
>Roms - You can dump your own for back up purposes - this is legal under software laws
>Keys/BIOS files/etc - You CAN NOT dump, copy or duplicate these as they are protected under software laws.
That is quite literally how it works. If Nintendo sued you for roms you'd have an out by proving you dumped them yourself. If they sued you for sharing keys you'd be fucked since you should not even have access to those, meaning you breached the law and committed a crime.

You don’t get VAC banned for simply modifying your game. You only get VAC banned for using cheats in multiplayer games, and its only for multiplayer and Steam accounts are free (and so is being able to use your own internet).
Shit is not comparable and you’re late in italian.

Those “you’re not buying a gane you’re buying a liscene” bullshit talking points I see constantly to defend anti-consumer practices, yet no one can’t why someone other than suits and shareholders should support it. Well at least reasons that aren’t malicious in nature.

Sony Interactive Entertainment isn't Japanese anymore though, and the main core of Sony would rather not risk its multiple industries just to help the vidya branch they don't care for ward off a lawsuit from Nintendo over dumbass pokeymans and bootleg pokeymans.
You have to remember Sony's biggest sources of profit are the toes dipped into electronics and music, and pouring funds into Pocketpair VS Nintendo is taking away from those other industries, showing weakness that other megacorps can exploit to push Sony out.

The whole "license" thing will never go away. True it sucks for the consumer, but the licensing laws are the only thing preventing someone from just buying the game and infinitely copying and distributing it online without repercussion. Even if the law does a complete 180 and sympathizes with the consumer, it will never take away those laws. The moment the consumer actually "owns" the product they've bought, it effectively means they're free to do whatever they want with it IP-wise. Every single game company would completely crash because they won't have exclusive rights over their IP anymore. The moment a game goes public, it will effectively have zero worth because anyone and everyone would have the right to copy and distribute it infinitely.

Not the point. The entire reason buying a game only gives you a "license" rather than "ownership" is specifically to prevent you from copying and distributing it. As long as there are limitations placed on what you can or can't do with a product, you cannot legally have true and complete "ownership" of it.

This is true of books as well. Yes, you own the physical book, but you do not have the legal right to reprint and distribute it. Because you lack that legal right, you cannot truly and definitively be said to "own" that book.

Absolutely right. These protections already exist for videogames too. You cannot legally distribute unlicenced copies of Mario Kart. Nintendo decided they aren't content with the protection the law affords them so they took the law into their own hands using DRM to prevent the production of unlicenced copies, which would normally be a legally protected right

Sure, but that argument isn't legally defensible unless it's specifically written into the law. If this law didn't exist, the owner of a property would not legally be able to prevent you from just copying and distributing a game as you please. The reason this disclaimer exists for any media dependent on the distribution of copies is specifically to give those owners to legal right to press charges should someone copy and distribute their work.

So LEGALLY, for primarily their own protection, companies HAVE to inform you that what you are purchasing is merely a license, and then you do not legally own the code or copyrighted material within the product you have purchased. This legal distinction must be made to cover their own asses.

>>712967383
"Reprint" is actually part of it. Strictly speaking, there is no law to prevent you from making copies of a game, this is true. But what you can't do is redistribute those copies. In contrast, there is no law preventing you from redistributing the one copy of the game you DID purchase. We legally do not have the right to sell distribute copies/reprints, but we DO have the right to distribute legal copy of the game we own. If we didn't, then we wouldn't be able to lend them to friends, nor would we be able to sell them as second-hand goods.

The reason companies use DRM is primarily due to the overwhelming number of bad actors who do redistribute copies of their games online. If people kept their home-made copies to themselves and never distributed them to others ever, we wouldn't be having this conversation.
